3 - Warranties

All our products are manufactured to the highest quality. Please contact our sales or customer service team for information on individual product warranties. All products are warranted against manufacturing defects, except for all moving parts and seating upholstery which have been affected by usage related wear and tear. Algarfurniture, reserves the right not to apply the warranty in cases of inappropriate use or when the product has been tampered with by a third party or interventions by non-authorised personnel.

Moveison has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of IVA unless stated otherwise, and where applicable. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

10 - Payment

Payment for orders placed on line will be made via bank transfer or on delivery by cash, card or cheque. Alternatively, payment can be made instore by card, cash or cheque prior to delivery. We will normally ask for a deposit to secure the goods ordered this will normally be up to 50% of the total order value and should be paid by the means listed above Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods. The price you pay is the price displayed on this website at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Title to any products you order on this website shall pass to you on delivery of the products, provided that we have processed and received payment in full for the products. In all cases all goods reman the property of Algarfurniture Lda until full and final payment has been made All prices include IVA (where applicable) at the applicable current rates but exclude delivery charges unless expressly stated otherwise. All credit card transactions are taken in Portugal and our transaction currency is in Euros (€).

11 - Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. We reserve the right to offer alternative products that are similiar as long as they are of the same or greater value.

12 - Ordering Errors

You are able to correct errors on your order up to the point at which you click on "submit" on the final page of our ordering process. Alternatively you can contact our customer service team on the number provided.

13 - Delivery

We would like to add that any mention of free delivery is only relevant if the delivery address is in the region called Algarve. We will inform you of any other delivery costs if your delivery is outside this zone. Delivery charges vary depending on the type of products ordered and the service you select and cannot be refunded. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors and all goods and products are subject to availability. Algarfurniture shall be under no liability for any delay or failure to deliver the products within estimated timescales. If you are purchasing to replace some of your existing goods, we also recommend that you do not dispose of your existing goods until your new goods have arrived and been checked for damage.

14 - Packaging

All products are subject to changes in packaging to ensure the best and safest delivery, if we think that your goods will be better suited in a differently branded box / container we will use this as an alternative packaging solution.

15 - Can I Collect My Order From Your Shop/Office?

We do hold stock at our showroom / offices / warehouse. All orders are dispatched from our storage facility and therefore we can accommodate pick up from our offices or at our warehouses. Our head office is based in Chincato, Lagos - please telephone before ordering to confirm.

16 - Acknowledgment & Acceptance of Your Order

If you have supplied us with your email address, we will notify you by email as soon as possible to acknowledge your order. Please note that this e-mail is not an order confirmation or order acceptance from Algarfurniture. Our acceptance of your order will take place upon dispatch of the product(s) ordered.

17 - Changing or canceling recommendations

Under the Regulation of the Consumer Contract, the right to cancel your order begins at the moment the user places the order and extends up to 14 days after delivery takes place with the user. You can cancel an order online by emailing or writing to Algarfurniture Lda, EN125, Chinicato, Lagos, 8600-334. Please quote your order number in all communications. If your order is already being shipped, you probably will not be able to cancel it before delivery. You have the right to cancel up to 14 days after delivery. Once the order cancellation is confirmed, you have an additional 14 days to return it. It is your responsibility to cover all costs of returning the products if you do not cancel before dispatch. We request that returned items be returned in their original packaging where possible.

18 - Returns Policy

Delivery discrepancies: Any discrepancies must be reported as soon as is reasonable after delivery, preferably within 24hrs. On arrival, if packaging appears damaged it is recommended that this is marked on the delivery note before you sign for the goods.

19 - Missing Items

On delivery: Should an item be missed or appear not delivered then we request that you notify us as soon as possible, preferably within 24hrs of initial receipt of delivery - we will not be held responsible for missing items if you have agreed for a delivery to be left somewhere without a signature. On assembly: Should a part appear missing from an item please report the item that is missing the part along with a description of part you believe to be missing. On both the above instances replacement goods will be despatched as soon as possible.

20 - Faulty Goods

Damaged goods must be reported to us as soon as is deemed reasonable, usually within 24 hours of delivery. It is the responsibility of the recipient to check for any damage sustained to the goods during transit, and indicate any damages on the delivery note. Unfortunately, if you do not indicate any damages on the delivery note, we are unable to claim from our carriers for the damage and will be unable to replace the damaged item. You must report the fault to us with a full description of the alleged fault/damage. If the fault is deemed a manufacturers fault or to have occurred during the manufacturing process, then we will replace the faulty item or part FOC. If the damage has occurred during the transit we will replace the item or part FOC. If items are lost in transit we will replace this FOC. In all instances we will request photographic evidence to be supplied of the damaged or faulty good. When acceptance of an order takes place, the consumer loses the right to reject the goods, within 14 days, unless the item has been altered or use of the item continues after a complaint is registered with us. All our stock is of a high quality and with correct use shall not experience any problems other than eventually suffering from general wear and tear. A consumer has no rights in respect of defects that are bought to his/her attention before the sale. A consumer cannot claim for damage he/she causes either by neglect or misuse.

21 - Unwanted Items/Order Mistake

Please contact our offices within 14 days of your receipt of the goods, should you wish to return the item(s). If you wish to cancel the contract you must indicate this in writing or another durable medium such as letter, or email within the cancellation period. Please state your order number in all communications. Where an item(s) is/are not wanted or has been incorrectly ordered the customer is responsible for payment to return the item(s). The item must be returned to us together with a completed returns form. All goods should be returned with their original packaging and in the same condition they were delivered. We will offer a refund for goods, however any transport cost charged will not be refunded. If unwanted Items are not returned, a fee will be charged to cover the direct cost of the recovery. In this occurrence you have statutory duty to take care of the goods while in your possession and to ensure that Moveison receive the goods undamaged.

22 - Refusal of Delivery

If you refuse delivery of an order you will be subject to a return fee deemed reasonable in accordance with the order. You will also lose the initial postage paid to cover administration costs of despatching the goods. These fees will be deducted from the refund amount which shall be issued once the goods are received back in our warehouse.

23 - Export Restrictions

We will specify any export restrictions that apply on any of our products on individual product listings. Any export restrictions will also be clearly indicated at checkout.

24 - Links to Other Websites

We have placed links on this website to other websites we think you may want to visit. We do not always vet these websites and do not have control over their contents. Algarfurniture cannot accept any liability in respect of the use of these websites.

25 - Exclusions of Liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Algarfurniture or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of there maining provisions.

Algarfurniture make no representation that any products or services referred to in the materials on this website are appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable.

28 - Law, Jurisdiction & Language

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Portuguese Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of Portugal. All contracts are concluded in Portuguese. These terms and conditions do not affect your legal rights.
